Case Against DP Gachagua Over Remarks Against NIS Boss Noordin Haji Withdrawn

A Nairobi Court has allowed withdrawal of a case filed against DP Rigathi Gachagua over remarks he made against National Intelligence Service Director Noordin Haji.

The high court allowed an application by Fredrick Bikeri seeking to withdraw the case.

The case came up for mention today and through Bikeri’s lawyer Danstan Omari, the petitioner asked the court to allow him to withdraw the case.

He filed a notice of withdrawal stating that he wished to wholly withdraw the entire suit.

“Take notice that the applicant herein, Fredrick Bikeri wishes to wholly and voluntarily withdraw the entire suit dated 28th June 2024 with no orders as to costs,” reads the notice of withdrawal.

The court allowed the application and withdrew the matter with no orders as to costs.

In the matter, Bikeri had argued that the remarks made by DP Gachagua against Haji were “untruthful, inciting, and unlawful” and do not meet the expected standards for a Public Officer under Articles 73 and 75 of the Constitution, as well as the Leadership and Integrity Act.
