An employee of Seraph Engineering Limited has been arraigned in a Nairobi court facing charges of conspiracy to defraud the company director.
Lucy Wamaitha Githaiga was charged that on March 10, 2021, at an unknown place in Nairobi Kenya, she conspired with other people already charged in court to defraud the company director, Mr. Patrick Mweti John, of an unidentified amount of money.
According to the prosecution, the accused person, together with her accomplices, falsely opened an account domiciled at Standard Chartered Bank by pretending that it was a genuine account for Seraph Engineering Limited.
Her lawyers put on a spirited fight before the court in an attempt to block her from taking the plea, saying they were in the process of negotiating with the company director to have the matter settled out of court.
However, both the prosecution counsel and the complainant’s lawyer objected to the plea being deferred.
In a ruling delivered by Magistrate, R.M. Ndombi, the court said the accused person can pursue alternative dispute resolution at any stage of the case; hence, she should proceed and answer for her charges.
She denied the charges and was released on a Ksh 1 million bond with an alternative cash bail of Ksh 300,000. The case will be mentioned on August 1.
