Chuka Law Court’s Resident Magistrate Hon. Oscar Chess Kinyua sentenced a 58-year-old Loyd Muriuki Nyaga to life imprisonment after being convicted of defiling a child contrary to Section 8(1) as read with 8(2) of the Sexual Offences Act, No. 3 of 2006.
The court ruled that the prosecution presented compelling evidence, including testimonies from four witnesses among them, the doctor and the investigating officer.
Among the evidence produced were the birth certificate, P3 form, PRC form, treatment notes proving the age of the victim, and evidence of defilement.
The victim is 12 years old with special needs living with her single mother, who also suffers from cerebral palsy.
Previously, the accused was found guilty of a similar offence involving the same victim.
It was reported that the accused defiled the said victim while he was out on bond for the initial offence.
