A Kisumu court has sentenced a man to life imprisonment after he was found guilty of defiling a 4-year-old child in the Sega Sega area of Kisumu Central, Kisumu County.
The accused faced a primary charge of defilement contrary to Section 8 (1) as read withSection 8 (2) of the Sexual Offences Act No. 3 of 2006.
He was also charged with an alternative count of committing an indecent act with a child, contrary to Section 11 (1) of the same Act.
The court heard that the offence occurred on January 6, 2025. On that day, at around 1:00 p.m., the accused lured the minor into his house.
Upon gaining her trust, he forced her to remove her undergarments and proceeded to sexually assault her.
The prosecution, led by Mr. Newton Ochieng, presented a compelling case, relying on the testimonies of five witnesses.
These included medical experts, eyewitnesses, and individuals familiar with the child’s condition before and after the assault.
Their statements collectively established the events that unfolded and directly implicated the accused.
In delivering the judgment, the court found that the prosecution had proven the charge of defilement beyond reasonable doubt.
The trial magistrate ruled that the evidence clearly satisfied the legal definition of defilement under Section 8 (1) and (2) of the Sexual Offences Act.
As a result, the court convicted the accused and handed down the maximum penalty life imprisonment.
