Court Orders New Mental Assessment in KNH Murder Case

The High Court in Kibera has directed a fresh mental evaluation for Kennedy Kalombotole, a patient accused of murdering a fellow patient at Kenyatta National Hospital (KNH) earlier this year.

Lady Justice Diana Kavedza on Thursday ordered that a psychiatrist from KNH be granted access to the Nairobi Remand Prison to conduct the assessment. The evaluation will determine whether Kalombotole is mentally fit to stand trial.

Kalombotole, who had been admitted to KNH since December 1, 2024, allegedly murdered Edward Maingi Ndegwa on July 11, 2025, at Ward 7B, Group C (Male) of the facility. The circumstances surrounding the incident remain under active investigation.

The court further directed prison authorities to ensure that the accused continues to receive diabetic treatment and other prescribed medical care while in custody.

According to Senior Assistant Director of Public Prosecutions Gikui Gichui, the new psychiatric evaluation is critical to ensuring the suspect’s mental capacity is properly assessed before the commencement of trial proceedings.

Justice Kavedza scheduled the matter for mention on November 13, 2025, when the court will review the psychiatrist’s report and decide whether the accused should face a formal murder charge.

The case has drawn public attention, highlighting concerns around the handling of patients with mental and medical conditions within public hospitals and the criminal justice system.
