The High Court in Nairobi has refused to issue temporary orders stopping the delivery of judgment in the murder trial of the late Kabete MP George Muchai.
The request was made on Thursday during a mention of Petition No. 80, which is closely tied to the high-profile case.
Lawyers representing the petitioners told the court that the criminal judgment is slated for December 17, 2025, and urged the judge to either determine the petition before that date or suspend the verdict until the petition is resolved.
The presiding judge rejected the oral plea, stating that halting a criminal judgment is a matter of grave legal consequence and must be pursued through a formal written application.
The court directed the petitioners’ lawyers to file such an application if they wish to seek a stay order.
The judge confirmed that all submissions in the petition have been filed and adopted, with directions to follow in due course.
Meanwhile, a memorial service for the late MP will be held at his Kamulu home in Nairobi on Saturday, marking ten years since his assassination.
Muchai was gunned down along Kenyatta Avenue on February 6, 2015, alongside his driver and two bodyguards.
Seven suspects; Raphael Gachii alias Kim Butchcher, Kimani Anyonyi alias Musti, Stephen Lipapo alias Chokore, Erick Isabwa alias Chairman, Jane Wanjiru alias Shiro, Margaret Njeri, and Simon Gichamba — remain on trial for the killings, all having denied the charges.
