High Court Grants Bond to ‘Mathe wa Ngara’ After Overturning Earlier Ruling

The High Court has overturned a earlier ruling that denied bond to Nancy Kigunzu, popularly known as ‘Mathe wa Ngara’.

Justice James Wakiaga allowed her appeal and set aside the decision of the JKIA Law Courts.

He directed that Kigunzu be released on a bond of Ksh 500,000 with a surety of the same amount.

Justice Wakiaga further ordered that she must report to the investigating officer every 30 days.

He also warned her against engaging in any similar offence while out on bond.

The new bond terms replace those issued by Magistrate Renee Kitangwa, who had denied her release after she was charged.

Kigunzu had been denied bond at the lower court while her co-accused, David Ochieng and Christopher Odipo, were granted bond of Ksh 1 million each.

All three were arraigned on August 12 to face charges of trafficking narcotics and conspiracy to traffic narcotics.

The prosecution alleges that Kigunzu was found in possession of 18.3 kilograms of cannabis valued at Ksh 6 million.

Her successful appeal now clears the way for her release under enhanced supervision as the case proceeds to full hearing.
