Hon R.K Ondieki (SPM) had tough time in fixing the appropriate date for conversing bail terms in a case where a Pakistan citizen is charged with fraud.
Muhammad Adnan Tahir is accused of obtaining property valued at Ksh 12,856,500 from New Be Company Limited in Embakasi by false pretense.
It is believed that Muhammad Adnan on 14th march 2018 being the director of ASQAM merchandising company defrauded 2315 packs of diapers, 1120 ceramic mugs,400 iron boxes and 900 pieces of water dispenser from the said company.
He was arrested and arraigned in Court on 28th march 2019.
He however absconded after his first release on bond. He was later on arrested and apprehended in court on 14th February 2022.
The trial court fixed Friday morning as the bond ruling date.
The prosecution objected to his release on bond stating that he has absconded court proceedings times without a number.
Further, prosecution argued that if released, there is no guarantee that the accused will ever be traced given the fact that he has three different passports.
“Your honor if the accused person is released on bond there is no guarantee that we will trace him in the next three years and that is if we will ever trace him” said the prosecutor.
Mr. Muhammad rose to object the sediments from the state counsel saying that he does not see any reason why he should be denied bond in a country where even serious criminals like murderers are allowed bond.
“Sir, Babu Owino shot someone by the neck but he was still released on a bond. Please am like your son and I pray for your mercy. Am a family man am married to a Kenyan…” quoted the accused person in mitigation.
The court fixed his bail term determination on 23rd February 2022 but the accused rose to object the decision and succeeded convincing the court to alter the ruling date to Monday 21st march 2022.
