Prime Suspect In Forest Road Assault Denies Charges

Zachariah Nyaore Obadiah, the prime suspect in a sexual assault involving a female diplomat at Forest Road has finally been arraigned in court.

Appearing before senior principal magistrate Esther Kimilu of Milimani law courts, Nyaore was charged with three felonious offenses.

He is charged with robbery with violence, committing an indecent act with an adult, and malicious damage.

However, Nyaore denied the facts of all the charges. The prosecution objected to his release on bond stating that he abandoned his phone when he realized the DCI officers were tracking him. 

The Investigating officer told the Court that the suspect ran away without saying goodbye to his spouse who could give investigative leads, and finally, he was arrested at the Isebania border of Kenya and Tanzania.

The defense counsel in rebuttal argued that sentiments from the spouse of the accused cannot be used as evidence against the accused according to Kenyan law and therefore the court should dismiss the prosecution’s claims and release the accused on reasonable bail terms.

The court through magistrate Esther Kimilu ruled that the case will be mentioned on March 31, 2022, for directions on whether to release the accused on bond or bail pending a hearing and determination of the case.
