Nandi County Senator Samson Cherargei caused a premature adjournment of his hate speech proceedings after openly defying court orders.
Senator Cherargei deliberately chose to hold the Court hostage for over three hours demanding that his case must be adjourned to a later date to pave way for his campaign.
He claimed that the party primaries are just around the corner and he needed enough time to solicit votes.
He accused the court of being impartial telling the presiding Magistrate that she has consistently depicted enmity throughout the case hearing.
Senator Cherargei continued shouting in Court and defied orders from Magistrate Micheni Wendi of Milimani Law Courts to maintain calm for the case to proceed.
He quoted a case where Deputy Chief Justice Philomena Mwilu was involved claiming he should be treated with respect as the DCJ was treated.
However, the prosecution pleaded with the court to warn the Lawmaker to tame his tongue and stick to his case at hand.
The presiding Magistrate ordered the case to proceed and have the day’s witness testify. Nevertheless, Senator Cherargei could not permit the witness to take oath as he kept shouting, making it impossible for the Court to proceed with the hearing.
The magistrate ordered police officers to escort the senator out a move which to he objected to causing more disturbance.
Ultimately, the Court ordered the Directorate of Criminal Investigations (DCI) and Inspector General of Police to investigate Cherargei to determine whether his contact today in Court amounted to contempt of Court and causing a disturbance and thereafter open prosecution against him.
Senator Cherargei is charged with Ethnic contempt. It is alleged that in 2019 he made utterances in a public rally that amounted to hate speech.
