On Wednesday, Kahawa Law Courts Chief Principal Magistrate Diana Mochache will decide whether the Police Internal Affairs Unit can bring a case before her court.
The IAU had asked the court to allow the police to detain four police officers suspected of involvement in the disappearance of two Indian men and their taxi driver.
The IAU requested that the four be held for 30 days while investigations were conducted.
Only the DCI, DPP, or the National Police Service Commission, according to the defense team led by lawyer Dunstan Omari, can bring cases against police to court.
