Court Orders Man Charged With Fraud To Pursue Out Of Court Settlement

Court has given last chance to a man charged with forging a title deed and obtaining Samsung and iPhones worth Ksh 1.2 million to pursue out of court settlement with his complainant.

Nelson Ogega Matoke appeared in Court today for the hearing of his fraud case of obtaining six samsung phones and two iphone 13 pro max phones all valued at Ksh 1.2m.

However, his defense lawyer asked the court to grant an adjournment for the case stating that the accused person has indicated his intention to pursue out of court settlement.

“Your the matter was coming up for hearing today, however we would like to pray for an adjournment due to the following reason. The accused person has indicated his intention to reach out to the complainant and the settle this matter amicably” said the defense lawyer.

Nelson Matoke who is out on a bond of Ksh 400,000 was charged with making a false title deed of land in Kajiado purporting it to have originated from the registrar of land with intention of using it as a security to obtain the phones.

During the plea taking, the prosecution informed court that the accused person has another similar case before Kiambu Law Courts.

According to the ODPP, Mr Matoke had a pending warrant of arrest before Kiambu which was issued on August 30, 2022.

He was expected to appear before Kiambu Law courts on August 2022 but he had been at large.
