Man Risks Death Sentence For Violent Robbery

A middle-aged man risks a death sentence after being accused of robbery with violence.

Waren Siago Mwimbi may find himself serving a life sentence if convicted to a robbery with violence case which he was charged with in a Nairobi Court.

The suspect, Waren Siago is accused of stealing a Samsung Z phone valued at Ksh 250,000.

According to the charge sheet, the suspect on July 28, 2023, at Runda Westland Sub-County within Nairobi, jointly with another person yet to be arrested, attacked John Mwangi Kamau, a resident at Runda Estate and robbed him of the said phone valued at Sh 250,000.

Appearing before Principal Magistrate Benmark Ekhubi, the suspect denied the charges and was released on a bond of Ksh 200,000 with an alternative cash bail of Ksh 150,000.

According to sections 295 and 296 of the Penal Code, anybody who uses or threatens to use violence during a robbery is liable to an offence of robbery with violence which is punishable by death or lifetime imprisonment.

The Penal Code, Section 296 (2) sets out the elements of robbery. To qualify as robbery with violence, the evidence of the theft, the number of assailants, whether the appellant was armed with a dangerous weapon, and whether the appellant beat the complainant has to be determined.

The case proceeds on August 30, for pretrial.
