In its presidential petition filed on Monday, the Azimio la Umoja One Kenya Coalition requested several orders from the Supreme Court.
Among the orders sought are the annulment of the August 9 presidential election and the holding of new elections by the IEBC.
The coalition has also asked the Supreme Court to order the IEBC to tally and verify votes after the results were declared null and void, and for Raila Odinga and Martha, Karua to be declared legitimate winners of the election.
The following orders are also sought:
- That Wafula Chebukati’s fitness to hold public office is declared unconstitutional.
- Chebukati be declared to have harmed the country and his office.
- Examination and forensic audit of all IEBC equipment, systems, and technology used in the presidential election, including KIEMS kits, servers, and the portal.
- Examination and forensic audit of all presidential election returns, including but not limited to Forms 34A, 34B, and 34C.
- All rejected and spoiled votes must be scrutinized.
- Rejected and spoiled votes must be counted as part of the total number of votes cast and included in the final presidential election tally.
- A court order be issued directing DCI to produce a laptop seized from a UDA agent, as well as a report on the forensic analysis of the laptop.
- DCI must produce statements, photographs, reports, equipment, laptop computers, phones, and other electronic devices seized from Venezuelan nationals.
- Allow access logs to all server used by IEBC in the presidential election.
- Within 48 hours, the IEBC produce all election materials, including electronic documents, devices, and equipment, for the presidential election.
- Declare the IEBC in its current form incapable of conducting a proper, credible, and verifiable presidential election.
- Declare that the violation of the law in the presidential election was substantial and significant, and that it affected the outcome of the results.
- Remove the presidential election results from the IEBC records and declare the verified re-tally results as the valid results.
- In lieu of the foregoing, the presidential election results of August 9 be declared invalid, null and void.
- Declare that President-elect William Ruto did not receive 50% plus one of the total votes cast.
- Issue orders rescinding the gazette notices naming Ruto and Rigathi Gachagua as President-elect and Deputy President-elect, respectively.
- That the decision of the dissenting IEBC commissioners to reject the presidential election results be declared constitutional.
- The petition’s costs will be borne by the IEBC, Chebukati, and DP Ruto.
