Azimio’s Lawyer Danstan Omari To File Application To Have Babu Owino Produced In Court

Azimio Legal team led by Danstan Omari intends to file an application seeking to have Embakasi East MP Babu Owino produced in court after his arrest early this morning.

Omari says he has instructions from Raila Odinga to file a habeas Corpus application because they don’t know the whereabouts of Babu and Raila private security Maurice Ogeta.

Others whose whereabouts remain unknown are Dennis Onyango, Hon. Ken Chonga, Hon. Teddy Mwambire, Hon. Wilfred Odallo, Hon. Redson Onyango, Eric Otieno and Anthony Otsyula.

The application states that the abducted lawmakers are ardent members of the Official Opposition in Kenya, to wit, the Azimio One Kenya Alliance and strong supporters of the Orange Democratic Movement Party Leader H.E. Raila Amollo Odinga.

Further, the application states that Babu Owino and the rest were on the 19th of July 2023 arrested at various places within Nairobi County and whisked to various destinations that are unknown to their family members, friends and acquaintances within the ranks of the official opposition of the government in Kenya.

“Before the unconstitutional, illegal and surreptitious abduction and forceful detention of the Applicants herein, they had every intention of participating in the three-day country wide demonstrations beginning the 19th July 2023 that have been called by H.E. Raila Odinga to pressurize the government of the day to lower the cost of living especially following the passing of the Finance Act,2023 that despite its operation being stayed by the Constitutional Court, its effects continue to pain Kenyans,” reads the application.

Azimio claims that the said members were last seen with police officers some of whom not only wore their official uniforms but also drove GK vehicles where they were bungled up and whisked to unknown and/or undisclosed locations.

Azimio submits that the state continues to unlawfully detain its members without the authority of the courts and knowledge of their whereabouts being known to their loved ones.
