A Kabarnet Chief Magistrate court has today sentenced Raphael Kiplagat, to life imprisonment after he was found guilty of defiling a 4 years old girl.
The Office of the Directorate of Public Prosecution (ODPP) cited that the convict violated section 8 (1) as read with section 8 (2) of the sexual offences Act 2006.
The prosecution led by Joseck Abwajo and Vivian Retemeo, proved their case beyond a reasonable doubt that Kiplagat did in fact willingly and illegally defiled the minor on the 23rd day of August 2020 in Tabariny Baringo County.
Section 8 of Sexual Offences act states that “A person who commits an act which causes penetration with a child is guilty of an offence termed defilement.”
Part (2) dictates that “A person who commits an offence of defilement with a child aged eleven years or less shall upon conviction be sentenced to imprisonment for life.”
