The High Court of Kenya in Nairobi has certified urgent the matter seeking to block ODPP from charging Seargent Rashid Ahmed Hassan with the murder of two youths in Eastleigh.
Seargent Rashid is expected to appear before the Court to answer murder charges against Mr. Jamal Mohamed and Mr. Mohamed Dahir Kheri who were killed in a hail of gunshots on March 31, 2017, on 4th Eastleigh Street, 1st Avenue.
Upon receiving the notice of motion to charge him with the murder, he moved with speed to the High Court to prevent the office of the directorate of public prosecutions from charging him in any court of law citing a violation of his rights.
The High Court Judge was satisfied with the application, certified it urgent and directed the same to be served to the ODPP for directions on December 8, 2022 when pursuant to earlier directives, the officer is expected to take a plea in court.
