The High Court of Kenya has upheld the senate Impeachment against Meru County Governor, Kawira Mwangaza.
In his Judgement, Justice Bahati Mwamuye said that the Senate proceedings were conducted in accordance with the rule of Law since none of the petitioners nor the interested parties in the petition proved that the senate proceedings were prejudicial.
In determining whether the threshold for public participation prior to Governor Kawira’s Impeachment, Justice Bahati Mwamuye said that the issue of public participation was pending before Meru High Court and hence it would be improper for him to rule on the ground of public participation.
In determining whether the charges levelled against Governor Kawira before the senate met the constitutional threshold, the Judge ruled that a court should only be invited to determine whether the procedure followed during the Impeachment was in accordance with the constitution and not the merit of the charges.
According to the Judge, the petitioner did not demonstrate before the court that the procedure followed during the Impeachment process was unconstitutional.
