Four suspects in the death of a 47-year-old Lucy Wambui Kamau have finally been charged with manslaughter contrary to section 205 of the Penal Code.
The suspects are the proprietor of Body by Design clinic Edna Wanjiru, surgeon Robert Maweu Mutula and George Wakaria Njoroge.
They were charged alongside Omnicare Medical Limited alias Body by Design Kenya.
They are facing manslaughter charges in connection with Lucy’s death that occurred on October 6, 2024, allegedly after undergoing surgery from the said facility.
They appeared before Senior Principal Magistrate Samson Temu where they denied the charges.
Prosecution opposed release of the suspects on bail and bond.
However, the defence lawyers lead by Advocate Danstan Omari, Cliff Ombeta, Sam Nyaberi and Shedrack Wamboi objected to the said application to deny the accused persons bond saying that right to presumption of innocence is enshrined in the constitution and that the said right cannot be limited without a tangible evidence that the suspects were flight risks and they would interfere with the investigations or any witness.
The defence lawyers urged the court to release the suspects on reasonable bail and bond terms.
The court will rule on the bail and bond release application on April 3, 2025.
