Chebukati Ignored Conflicting Figures in Form 34 — Cherera

Cherera accused Chebukati in her affidavit of ignoring the computation errors in forms 34A and B and instead declaring the winner of the presidential vote without the majority of commissioners' agreement.

Juliana Cherera, the vice-chair of the Independent Electoral Boundaries Commission (IEBC), has accused his chair, Wafula Chebukati, of overseeing irregularities in the presidential tally.

Cherera accused Chebukati in her affidavit of ignoring the computation errors in forms 34A and B and instead declaring the winner of the presidential vote without the majority of commissioners’ agreement.

She claimed that Chebukati’s actions as chair of the commission were opaque and excluded other commissioners from decision-making. This came after another dissenting commissioner, Justus Nyang’aya, gave his account of events in response to the presidential election petition filed by Raila Odinga and Martha Karua.

In his reply affidavit, Nyang’aya listed all of the reasons that led to his personal decision to reject the presidential results that were formally declared by IEBC chairman Wafula Chebukati.

The commissioner stated that three electoral agency employees conspired with a foreigner to intercept and alter the original contents of forms 34A.

According to Nyang’aya, the IEBC trio is made up of Abdidahir Maalim, Moses Sunkuli, and Gideon Balang. They would then upload new results onto the system after amending the forms, and the new results would appear on the public portal as the official results. The foreigner, Gudino Omar, gained access to the servers on June 1 and would be active there at night, according to Nyang’aya. “I swear under oath that I am aware that a foreigner named Gudino Omar was able to access the commission’s server using user ID “O” and pull down results that had been uploaded from polling stations before uploading fresh results,” he says.

“I don’t understand what a foreigner would be doing on the commission’s server during the election period,” he adds. “I also don’t understand why Gudino Omor was always busy on the IEBC server at night.” The commissioner also claimed in his affidavit that the said foreigner set up camp in the IEBC servers as early as June 1 and stayed until August 15, when Chebukati officially announced the presidential results.

He also claims that there were hundreds of unauthorised logins to IEBC servers that could not be explained. “As far as I know, the commission has never been formally given the details of the other 377 people who access the IEBC server during the election period,” he said.
