According to the witness, Robert had full access to the safe, he opened the safe where a Caesar Pistol B156623 with nine ammunitions was retrieved.

The Prosecution side has today closed their case involving the charging of Businessman Chris Obure and his bodyguard Robert Ouko where the two are charged with the murder of Kelvin Omwenga as well as misuse and failure to secure a firearm.


According to the charge sheet on August 21,2020 at Senteu Plaza while Obure being a licensed firearm holder allowed his firearm to be used by Ouko to commit murder.
Ouko on his part is charged with being in possession of firearm and ammunition which was used to commit murder without a firearm certificate.
The offence is said to have been committed on August 2 at Colana Suites, House along Colana road in Kilimani area, Nairobi.
The two have already been charged with murdering Kevin Omwenga.
Today the prosecution side tabled their last witness, DCI Kilimani Mr. Mboya, the witness recalled that on August 21, 2020 at around 2345 hours, a group of people among them Wycliffe Omwenga went to Kilimani Police station and reported that Kelvin Omwenga had been shot dead by Robert Ouko.
The witness told the Court that receiving the information they proceeded to interrogate Robert who directed them to the office of Chris Obure where he had deposited the firearm.

According to the witness, Robert had full access to the safe, he opened the safe where a Caesar Pistol B156623 with nine ammunitions was retrieved.


From the investigation, Robert Ouko told the investigating officer that they were with the deceased person and some other people in the same house on a fateful day. “

Robert in his own statement told me that he went to the bedroom with the deceased purposely to retrieve the firearm from the deceased,” said the IO.


Wycliffe Omwenga, brother to the deceased said that while inside the Kitchen, they heard a gunshot and proceeded to confirm what was the issue only to meet Robert exiting the bedroom hurriedly while holding a firearm.


They proceeded to the bedroom and found the deceased lying on a pool of blood on his bed, they picked him and rushed him to the hospital where he was pronounced dead.


On further interrogation, Robert Ouko told DCI that the firearm belonged to Chris Obure.

“on getting this information, it was getting to August 22, 2020 we then summoned Chris Obure to our offices at DCI Kilimani, so that he could explain the circumstances surrounding the firearm which was used in the execution of Kelvin Omwenga” testified the DCI.


After completing their case, the Prosecution made an application in relation to the Firearm, that it be kept by the investigation officer in a case where the Court may recall it.


The defense is expected to file written submissions within 7 days. The matter will be mentioned on October 19, to set a date for ruling.
