CJ Koome Announces 45 Judicial Vacancies After Budget Freeze Lifted

Chief Justice Martha Koome has declared 45 vacancies for judges in Kenya’s superior courts, following a months-long hiring freeze caused by budget constraints.

In a gazette notice published on Tuesday, the Judicial Service Commission (JSC) confirmed openings for 15 Judges of the Court of Appeal, 20 Judges of the High Court, and 10 Judges of the Environment and Land Court.

“Pursuant to Section 30 of the Judicial Service Act and the relevant provisions of the Constitution, I, Martha Koome, Chief Justice of the Republic of Kenya, declare vacancies in the Office of Judge of the Court of Appeal,” read the notice.

The announcement comes after the JSC suspended a similar recruitment drive on January 22, 2025, due to budget cuts. At the time, the Commission appealed to the government for additional funding to meet operational and staffing needs within the judiciary.

Retirement Age and Eligibility

Koome also reiterated that judges of the Court of Appeal are required to retire at the age of 70, with an option of early retirement at 65, as per Article 167 (1) of the Constitution.

To qualify for appointment to the High Court, applicants must:

  • Hold a law degree from a recognized institution.
  • Be an advocate of the High Court of Kenya or have equivalent qualifications from a common-law jurisdiction.
  • Have at least ten years of experience as a judge, magistrate, legal practitioner, or distinguished academic in the legal field.

Application Process

The appointments will be made in accordance with Article 166 (1)(b) of the Constitution, alongside Article 162 (2)(b) and relevant provisions of the Judicial Service Act, 2011.
