Police Probe Assault Of A KCPE Candidate For Missing 400 Marks

The Ministry of Education has now launched an investigation into an incident in which a Class 8 pupil at Nyamninia Primary School in Yala, Siaya County, was allegedly severely punished by teachers for failing to achieve 400 marks.

Dr. Julius Jwan, Principal Secretary for Education, stated during the commissioning of the new Mtihani House in South C on Friday that Siaya County education officials have since visited the school to investigate the matter.

“A video has been going round of a learner being punished by teachers for not attaining 400 marks. It’s so bad…we have narrowed down and identified the school, investigations are ongoing,” he said.

The incident sparked public outrage after a video of the boy crying and showing marks from the punishment he claimed two teachers meted out on him went viral.

The boy stated that he was forced to flee the school after the punishment became too much for him, and that he tried his hardest to persevere but could no longer handle it.

“Nimejaribu kuvumilia lakini hata ukivumilia ndio wanazidi kukuchapa. Nimevumilia 11 years in that school na mimi sasa nimechoka. Afadhali sasa hata ujiue kuliko kufikiria vitu mingi,” says the boy amidst tears in the undated video.

While showing cane marks on his back, legs and thighs, the learner, who was in tears, alleged that two teachers assaulted him over what they termed subpar performance.

“Due to 400 marks nachapwa hivi? I think I should be able to achieve what I have already gotten but now if they want to force 400 in me and I can’t achieve it what will I do?”

The pupil said he was contemplating seeking transfer or staying at home after being assaulted at Nyamninia Primary School.

“If it’s a must that I score 400 marks in exams to avoid being subjected to torture, then I’d rather remain at home. Education shouldn’t be harmful,” he said.

Article 29 of the Kenyan Constitution, which deals with citizens’ freedom and security, prohibits corporal punishment, torture, and cruel punishment.
