The constitutional moment pronounced by President Kenyatta on Mashujaa day is fake, former CJ Willy Mutunga has said.
Mutunga said that moment was fertile in 2010 and not now, unless the President is admitting he failed to implement the promulgated constitution.
He said Uhuru should have subjected the BBI document to scrutiny by Kenyans before launching it. “There is no need to dump the document to the door step of Kenyan people. Its purpose is to entrench political power for the big 5 tribes”, Mutunga said.
He said Kenya’s big five tribes are the cause of political instability and said it is time for a moderate politician such as Mukhisa Kituyi, Kivutha Kibwana or Aukot to rule Kenya.
Mutunga said the BBI report is geared towards entrenching the interests of political barons from these tribes and not the hustlers who toil day and night for a living. At the same time, Mutunga says DP William Ruto is part of the barons, and is nowhere near the hustler status he claims.
The five big tribes in Kenya are the Kikuyu, Kalenjin, Luhya, Luo and the Kamba. DP Ruto is the prefect of the Kalenjin nation, Raila Odinga (Luo and parts of Luhia land), Kalonzo Musyika(Kamba) and President Kenyatta(GEMA). Speaking during a live Citizen TV show, Mutunga said there has never been enmity between ethnic groups in Kenya, but a situation is manipulated every 5 years to perpetuate political survival of the political barons.
He claimed the big five will coin other alliances by 2012, for purposes of power sharing. Political and tribal barons perpetuate impunity through their ethnic groups, thereby threatening stability, authoring political violence to hold and control power.
This, Mutunga said is the reason why Kenya cannot be ruled by a moderate politician such as Dr. Mukhisa Kituyi, Kivutha Kibwana and others.
The barons as currently constituted are manifested through the big five tribes- Kikuyus, Kalenjins, Luhias, Luos and Kambas.
“These are political barons, they are holding Kenya at ransom. They control 70 per cent of the votes”, Mutunga said.
The former CJ said these tribes will decide who rules Kenya, its a tyranny of tribes. The real liberation for Kenya will arrive when voters rebel against the big five, Mutunga said. “Forget the deep state. Uhuru can access intelligence from other spy agencies as the head of state, his horizon is very expansive”, Mutunga said.
The former CJ said Dedan Kimathi deserves a decent symbolic burial. It has happened in other scenarios when people disappear.
Historical injustices such as the issue of land need to be dealt with. There is need to exorcise the ghosts Kikuyus bore the brunt of colonial atrocities, there is need to discuss and exorcise these past demons.
He said Kenya cannot evolve to a country of ideals if the five political barons continue to intimidate Kenyans. Kenyan politics is anchored on tribalism, religion and myopism. There is no concrete political leadership space in Kenya. The five barons control politics. That is why Dr. Mukhisa Kituyi and Kivutha Kibwana cannot be “The barons narrative has evolved since 1957. This works. But there is hope, if Kenyans resist. We have made progress”, he said.
Mutunga said the constitution dispensation is the third liberation. Implementation is forth. He said Uhuru’s assertion of a constitutional moment is an acceptance of failure to implement the 2010 constitution. Professor Kibwana and Mukhisa Kituyi cannot be elected President of Kenya. The five political barons career allow them. These are Uhuru, DP Ruto, Raila Odinga, Kalonzo Musyoka and Musalia Mudavadi, Mutunga says he lives in a flat, pays service charge, attends estate Court meetings and hustles with live at a gated community.
Mutunga, an unapologetic Kamba traditionalist, hails from Nzambani Location, Kitui County. He is highly regarded in Kitui despite his controversial demeanor and sometimes hypocritical tendencies. ” Why should prophet Owuor be treated better than Jesus Christ. We have a problem here”, he said.
He said there are no hustlers in leadership in Kenya. Boda Boda riders can never ascend to presidential power. This is intra elite battles. Kenya is an outpost of foreign nations. It’s political psyche is decided elsewhere. ” Kenya has evolved positively. 1970 was hell. We have lost time but we are not empty handed. Devolution has worked”, he said.
He said he will never seek political office. “I have been a President. I cant accept to be an appendage of the 5 political barons in Kenya”, he said.
National debate should have preceded the launch of the the BBI report. A third force, devoid if the 5 tyrants is possible Musalia, Kibwana, Aukot can swing a surprise. Kibaki said politicians in Kenya are dishonest. Mutunga says Kibaki was Moi project in 1992, Uhuru was Moi project in 2002, Kalonzo was Kibaki project in 2007 and Moi was Kibaki project in 2007.
