Milimani Law Courts in Nairobi has acquitted the self-proclaimed private detective Jane Mugo in a case she was accused of threatening to shoot a businessman.
The court found that prosecution had failed to prove its case against the controversial spy.
According to Chief magistrate Susan Shitubi, there was glaring inconsistency in the testimony of the two witnesses presented by the prosecution.
According to the first witness, Jane uttered a threatening word to the complainant Deepa Shah that she would shoot her.
In his word the witness said Mugo said ‘or can I use this’ pointing to her waist indicating the pistol she had logged in her waist.
The court also trashed witness statement that Mugo had a pistol during the altercations.
In her judgment, Magistrate Shitubi found that the alleged pistol was not recovered when police raided Mugo’s residence.
She said the inconsistency by witnesses who were not cross examined left the court juggling on who to believe, but left with only option believing the defense side.
