Court Acquits PS Julius Korir In Wife Assault Case

Milimani Law Courts in Nairobi freed Water and Sanitation Principal Secretary Julius Korir of charges of assaulting his estranged wife Evelyn Koech citing lack of evidence to convict the PS.

According to the judgement rendered by Dolphina Alego, DPP failed to prove the allegations against him that he assaulted Koech while naked three days before her delivery at her Karen house in Nairobi on September 17, 2022.

“This court finds that prosecution has not proved their case as to the threshold and this court finds that accused herein be discharged under Section 215 of the CPC unless otherwise held in law,” the magistrate ruled.

Magistrate Alego also ordered that the Ksh20,000 cash bail deposited in court be returned to the accused.

While acquitting Korir, the magistrate noted the evidence adduced by the prosecution’s witness had a lot of inconsistencies as Koech did not allow the law enforcers to do their independent investigations in the case.

While detailing the inconsistencies from the prosecution case, Alego also found that according to the evidence tendered by the investigating officer John Obul in the case, he (the officer) was seemingly acting on instructions of Koech and could not do an independent job.

Further, the magistrate also noted Korir’s estranged wife did not produce a P3 form as required in law in assault charges.

The magistrate wondered why Stephanie Wakaba, a medical doctor from Nairobi Hospital, ended up giving evidence of how she took photos and videos of the patient yet she is only a medic.
