On June 23,2022, an heinous action by two law enforcement officers from Dandora Police station where the two officers brutally assaulted an advocate of the High court of Kenya angered and caused public outcry to the members of the public including the international justice mission.
The two police officers were apprehended and arraigned before Milimani Law courts in Nairobi to answer their charges.
Benedict Mugo and Moses Labu Kangere, appeared before Magistrate Bernard Ochoi of Milimani Law courts on Wednesday jUNE 29, where they were expected to take plea an assault accusations.
However, Joseph Kinuthia, the assaulted Advocate informed the court that the two police officers had compensated him fully for the damages incurred and pleaded with the court to permit withdrawal of the case.
“Your honor, this was a case of assault as per the charge sheet. Today I wish to inform this honourable court that pursuant to Article 159(2) of the Constitution of Kenya which encourages alternative dispute resolution mechanism, I have extensively engaged the accused persons with a view of settling this matter out of court and I have noted that the accused persons are remorseful and regrets their actions,” said the advocate in withdrawal of the case.
The presiding Magistrate allowed the case to be withdrawn noting that the victim is an advocate and an officer of the court whom the court believes cannot be manipulated in any manner to withdraw the matter without voluntary consent.
