Court Blocks Arrest, Prosecution Of Mwangi Wa Iria

Milimani Anti-Corruption Court has suspended plea taking against former Murang’a Governor’s wife Jane Waigwe Mwangi and her brother Solomon Mutura Kimani in the Ksh 140 million fraud case.

The new development came hours after the two were arraigned before the court facing corruption charges.

However, Mwangi Wa Iria, his wife and the other accused persons Lawyers led by Ndegwa Njiru informed the Magistrate Court that High Court sitting at Murang’a had issued orders revoking any decision by the ODPP to charge or prosecute the alleged fraud suspects.

Wa Iria alongside the other accused persons moved to court yesterday seeking orders barring their arrest and prosecution.

According to the orders presented in Court, the High Court Judge ruled that the ODPP, EACC and the Inspector General of Police should not arrest and or charge the accused persons pending the hearing and determination of the case filed before the Court by Wa Iria challenging his arrest and prosecution over the case.

According to Advocate Ndegwa Njiru, the orders by the High Court, stays the decision by the ODPP to charge or prosecute Hon. Mwangi Wa Iria, his wife and the other co-accused persons.

“This court remains bound by the orders of the superior Court. The taking of plea in his case is hereby differed pending the determination of a case filed at Murang’a.

The accused persons before this court are hereby unconditionally discharged.” Ruled magistrate Nzioki.
