The former Nairobi Union of Water and Sewerage secretary general will now have to remain in police cells until the completion of his forgery trial in Court.
Today Milimani Law Courts Principal Magistrate Martha Nazushi in a ruling concluded that Elijah Otieno, the former SG NUWASE had acted in contempt of Court orders.
In canceling the bond, the magistrate ruled that the prosecution had established that the former National Union of Water and Sewerage Employees Secretary General Elijah Otieno Awach proceeded to withdraw funds from the company’s account despite orders preventing him from interfering with the accounts.
“The applicant has established that the suspect herein continued to mingle with the complainant’s accounts by withdrawing funds despite a court order barring him from doing so. I will therefore proceed to cancel bond terms for the accused person.” ruled the Magistrate.
According to the charge sheet, Awach, on February 12, 2021, in Nairobi with intent to defraud, forged a signature on National Executive Committee minutes purporting it to have been signed by Ahmed Bashir Mohammed.
He was charged with a second count of uttering a false document.
The court heard Awach knowingly and fraudulently uttered a false document namely National Executive Committee minutes purporting it to be genuine minutes signed by Bashir.
He allegedly committed the offense on February 19, 2021, at the Cooperative Bank, Buruburu branch in Nairobi.
He pleaded not guilty before Milimani chief magistrate Esther Kimilu.
The case will be heard in September 2023.
