Court Closes Appeal Filed by ODPP, DCI Challenging Acquittal of Joshua Waiganjo

 

Lady Justice Grace Nzioka has closed an appeal filed by the Director of Public Prosecution together with the Director of Criminal Investigations challenging the acquittal of Joshua Waiganjo.

Joshua had been accused of impersonating a police officer in 2012, he was however acquitted by a magistrate Court in 2020, an acquittal which never settled well with the ODPP and DCI.

The ODPP and DCI appealed the acquittal to the High Court claiming that Joshua was illegally acquitted. 

The High Court ordered for a retrial of the case, however, Joshua appealed the decision to the Court of Appeal.

The Court of Appeal delivered a decision saying that the order by the High Court for a retrial was not proper or legal in the circumstances.

Following the decision by the appellate court, the judge said that the matter had been overtaken by events and marked it as closed.

It was the appellate decision that charges against Waiganjo be quashed and that he be set at liberty forthwith unless otherwise lawfully held.
