Court Declines MP Peter Salasya’s Request for Firearm Reinstatement

NAIROBI, June 4, 2025 — A Nairobi court has declined an application by the legal team representing Mumias East Member of Parliament Peter Salasya seeking the reinstatement of his firearm.

Principal Magistrate Paul Mutai ruled that the court lacks the jurisdiction to order the release of the firearm, which was confiscated as part of the evidence during Salasya’s arrest.

“The court cannot, at this point, determine the evidentiary value of the weapon,” Magistrate Mutai stated.

In the same ruling, the court dismissed claims that the MP’s rights were violated during his arrest, citing insufficient evidence presented by the defence.

“I find no evidence that the accused’s rights were violated, and the application by the defence stands dismissed,” Mutai ruled.

Separately, Salasya’s counsel requested that the legislator be allowed to attend future proceedings virtually — a request the court granted.

MP Salasya was previously arrested and charged with hate speech. 

He was released on a bond of KSh 500,000 or an alternative cash bail of KSh 200,000.The case is scheduled for a pre-trial hearing on June 18, 2025.
