Former Kiambu Governor Ferdinand Waititu has suffered a legal blow after the High Court dismissed his latest attempt to review the 12-year prison term he is currently serving over corruption charges.
In a ruling delivered on September 16, 2025, Lady Justice Lucy Njuguna rejected an application filed by Waititu on August 28, 2025, seeking to overturn his February conviction.
The Director of Public Prosecutions (DPP) had strongly opposed the application, terming it an abuse of the court process.
Waititu was convicted earlier this year and given the option to pay a Sh53.5 million fine or serve a 12-year jail term after the court found he irregularly received Sh25 million from Testimony Enterprises following a flawed tender award.
The judgment faulted him for failing to uphold good governance and protect public resources during his tenure.
Justice Njuguna ruled that the sentence will stand pending the hearing and determination of Waititu’s substantive appeal. She directed that the appeal be heard and concluded within 120 days, warning that unnecessary delays by the former governor could lead to the case being struck out.
Waititu remains in custody at Kamiti Maximum Prison after failing to meet stringent bond conditions, including depositing a Sh53 million bank guarantee. The case will be mentioned again in court on October 1, 2025.
