Court: Four Students In Lang’ata Fire Have A Case to Answer

Four of 11 students charged with burning Lang’ata Boys High School in 2016 have a case to answer.

The court also aquitted seven students after the prosecution lack of evidence.

In the case, eleven students from Langata Boys were charged with conspiracy to commit a felony, namely arson by planning to burn down form four block in the school in 2016.

They all denied the particulars of the charges and were released on bond.

Throughout the hearing, the prosecution produced eighteen witnesses majority of whom were students in the said school.

The trial magistrate, SPM Bernard Ochoi sitting at Milimani Law Courts ruled that the prosecution proved their case against the four students beyond a reasonable doubt to place them at their defense.

“Upon perusing the evidence tabled before me and the testimonies by the 18 prosecution witnesses, I am satisfied that the prosecution proved their case against four of the accused persons. This court will therefore proceed to place them in their defense. I am also convinced that the prosecution failed to prove their case against seven of the accused persons and I will therefore proceed to acquit them.” ruled the magistrate.

The court also found that the prosecution failed to table sufficient evidence against seven other students hence acquitting them against the charges.
