Court Issues Order Suspending Decision To Suspend Ketraco’s Boss Wamukota

Employment and Labour Relations Court has issued an order suspending a decision by Ketraco’s Board of Directors that suspended its General Manager Engineer Antony Wamukota from office.

Justice Byrum Ongaya said Wamukota established a case for the grant of the orders sought and that the threshold for suspending the board’s decision was met.

Wamukota moved to court on November 21, following the board’s decision contained in a letter dated November 15 this year that suspended him from office.

He termed his suspension as illegal arguing that he was never allowed to be heard.

In his court papers says the Board decided to express directions from the Ethics and Anti-Corruption Commission (EACC), which was contrary to their human resource policy and procedures manual.

“My illegal suspension was a planned, and predetermined decision influenced by the Ethics and Anti-Corruption Commission which Ketraco’s Board deliberately decided to overlook and flout its Human Resource Policy and Procedures Manual by taking the most distasteful decision of illegally and immediately suspending me,” Wamukota’s court papers read.

He further claims Ketraco never acted on any complaint and that EACC usurped the powers of Ketraco at its board meeting.

He submits that EACC chose to issue adverse recommendations leading to his immediate suspension even when there is still pending before the High Court a constitutional petition over the same.

He argues in that matter, the High Court issued an order restraining from arresting, charging or prosecuting him over any activity or any events relating to the Ketraco-Loiyangalani-Suswa Transmission Interconnector (II) Line Project.
