Nyamira Law Court has nullified the Nomination of MCA Dolphine Nyang’ara as the Jubilee Party nominee in the Gender top up category.
The petition was filed by Mitchelle Omwoyo, a voter from Bonyamatuta ward, who according to the petition was supposed to be nominated to the Nyamira County Assembly.
The petition was being heard by Chief Magistrate Hon. Willi Chepseba.
Omwoyo claimed that the Independent Electoral and Boundaries Commission (IEBC) did not use the correct list issued by the Jubilee Party, but instead used the list that was challenged before the Political Parties Disputes Tribunal.
She had argued in the tribunal that Nyangara was a resident of Kahawa Wendani ward and a voter in Kiambu County, and thus should not represent the women of Nyamira County.
In order to meet the two-thirds gender rule, political parties were directed in September last year to nominate 559 female ward representatives to the 47 county assemblies.
This was after only 100 women were elected as county legislators out of the 1,445 seats available.
