Court of Appeal suspends proceedings at High Court on Ahmednasir’s ban case

The legal battle of a Supreme Court ban against SC Ahmednasir Abdullahi from seeking audience at the Apex Court has taken a new turn after the Court of Appeal suspended proceedings at the High Court touching on the indefinite ban imposed on Senior Counsel and his associates.

The second Court in command on the land said the case will remain suspended until an appeal filed by the Apex Court Judges is heard and determined.

Senior Counsel Ahmednasir moved to the High Court after he was banned from ever appearing before the Supreme Court after the Judges accused him of persistently demeaning them.

The Jurisdiction of the High Court to entertain the case was vehemently challenged, however, Justice Chacha Mwita said High Court had jurisdiction to hear and determine the case.

The Supreme Judges moved to the appellate court after this decision by Justice Chacha Mwita.

According to the Judge, the high court has the power to hear and determine the case since the issues raised fall under the High Court jurisdiction.

“The court has a duty to determine whether his rights and fundamental freedoms in the Bill of rights have been violated,” said Mwita.

The High Court Judge declined an application by the Supreme Court Judges pleading with him not to entertain the case saying it would be a breach of the court hierarchy to entertain the matter.

Today Justices Pauline Nyamweya, Aggrey Muchelule and George Odunga said the case before Mwita will not proceed until the Apex Court’s appeal is heard and determined.
