Court Overturns Amos Kimunya Graft Acquittal

Justice Esther Maina of the Milimani High Court found merit in the ODPP's appeal and ruled that the former lawmaker had a case to answer.

The Directorate of Public Prosecutions (ODPP) has successfully challenged former MP Amos Kimunya’s acquittal.

The former legislator was charged alongside others in a land graft case worth Ksh 60 million.

Justice Esther Maina of the Milimani High Court found merit in the ODPP’s appeal and ruled that the former lawmaker had a case to answer.

The judge ordered Kimunya and his co-accused Lilian Wangiri (former Ministry of Lands Director of Land Adjudication and Settlements) to appear before the Anti-Corruption court’s trial magistrate, Lawrence Mugambi.

According to the Judge, the two accused persons risks a warrant of arrest against them should they fail to appear before the Magistrate on October 11,2022.

The ODPP represented by Alexander Muteti, Vincent Monda, Solomon Njeu, Caroline Kimiri and Christine Ndombi managed to convince the Judge to overturn the lower court’s decision of acquitting the two.
