Court Postpones Hearing in George Ototo’s Case Against KUSSCO

By Andrew Kariuki

The Employment and Labour Relations Court has deferred proceedings in a case filed by director George Ototo against the Kenya Union of Savings and Credit Co-operatives (KUSSCO).

The matter, ELRC Case No. E753 of 2024, came before Justice Onesmus Makau, who allowed an application by KUSSCO seeking additional time to introduce expert evidence and file a supporting witness statement.

The application was presented by advocate Cecil Miller, who is representing KUSSCO in the proceedings.

Lawyers acting for Ototo, advocates Mukonyi and Waweru, opposed the request and informed the court that they were prepared to proceed with the hearing as scheduled.

After considering submissions from both sides, Justice Makau ruled that granting the request would serve the interests of justice and ensure that all parties have a fair opportunity to present their case.

While allowing the application, the court imposed conditions on KUSSCO, directing that the expert witness statement be filed and served before the close of business on the same day.

The case has now been rescheduled and will proceed on June 11, 2026.
