Court stops Wafula Wamunyinyi from holding party National Delegates congress

The planned national Delegates Congress NDC summit by the rebel Ford kenya party leader Wafula Wamunyinyi has been stopped by High Court.  The convention was due on Saturday.

The court in directed the respondents and interested parties to file submissions within seven days, The court further set November 25, 2020 as the mention date.
The Wamunyinyi allied party Secretary General David Eseli Simiyu had published a notice on October 31,indicating that the Party will hold the NDC on November 21 at the Bomas of Kenya, Main Auditorium.

“That pending the hearing and determination of this application and in order to ensure full and due compliance with orders of this honorable court given on 15th June, 2020, its hereby ordered that the Notice issued by Eseli Simiyu as published on 31, 2020 in the Daily Newspaper or any other media and the date convening the National Delegates Congress of the FORD-Kenya for 21 November, 2020 or any other date be and is hereby stayed,” directed the court.

In May the partys national executive council had resolved to remove Senator Moses Wetangula as Party Leader.

 Kanduyi member of parliament Wafula Wamunyinyi was installed  on an interim basis in changes that the ousted party leader termed as a cou section of the party’s leadership.

Wetangula’s faction in A rebattle held a meeting  and declared changes null and unconstitutional in a bid to wrestle control of the party which had been taken over by Tongaren MP Eseli Simiyu and his Kanduyi counterpart who was named the party leader.

The two factions have made it a full blown war with each side vowing to outshine the other ,at the political parties disputes tribunal and the registrar of political parties.

The Court of Appeal is yet to determine an appeal filed by Eseli and Wamunyinyi challenging a High Court decision on June 25 under which conservatory orders were staying the Gazette Notice effecting leadership changes.

Embattled party leader and his secretary general Kimili MP Chris Wamalwa had termed the meeting as an illegal gathering as they vowed to bring sanity in the party, recalling late Vice president Michael Kijana Wamalwas wars that later had him rise to vice presidency.
