Court Trashes IEBC Evidence In MPs Petition

The Bungoma High Court threw out the Independent Elections and Boundaries Commission’s evidence in the lawsuit challenging Dan Wanyama’s election as Webuye West Member of Parliament in the August 9 elections.

The affidavits sworn by the IEBC and the Webuye West returning officer were removed from the Court records.

Justice William Musyoki held that the affidavits sworn by the IEBC and the Webuye West returning officer were invalid. The judge dismissed all of the affidavits and evidence supporting the electoral body’s affidavits.

The petitioner, Kelly Walubengo, had requested the court to reject the two’s submissions owing to suspected fraud in procuring the affidavits.

Kelly Walubengo, filed a lawsuit in September to dispute the election, which he deemed fraudulent.

Wanyama was proclaimed the winner by the IEBC with 14,325 votes against Walubengo’s 12,005.
