CS Soipan Tuya Sues Estranged Husband, Seeks Sh525,000 In Child Upkeep

Environment CS Soipan Tuya has moved to court seeking custody of two children she sired with her estranged husband.

In her court papers filed at the Nairobi Children’s Court, the CS is seeking Sh525,000 from the estranged husband Stephen Ole Kudate as monthly upkeep for the children.

Kudate is a former Majority leader of the Narok County Assembly.

The CS is also seeking a court injunction barring the husband from abusing her and the children either physically, emotionally, verbally or psychologically.

In what is emerging as a troubled marriage, Soipan further wants the court to stop Kudate from insulting and issuing threats against her of whatever nature.

The Environment CS has asked the court to block Kudate from interfering with her place of work, going near her and even making phone calls to her as well as interfering with her life.

“That the Honourable Court be pleased to issue a permanent injunction restraining the defendant by himself, servants, agents and representatives from accessing, entering or in another manner interfering with the plaintiff and her children’s peaceful enjoyment of plaintiff’s properties,” CS Soipan stated in the affidavit seen by Nairobi Leo.

The affidavit was sworn on September 20, 2023, via Simon S. Wekesa advocates.

The properties she wants the estranged husband blocked from include residential houses in Kileleshwa Estate, Karen Estate in Nairobi and Naroosoru in Narok South.

In the affidavit, Soipan has listed the properties as hers.

“That the Honourable Court be pleased to issue a permanent anti-molestation order/ protection order/ non-molestation order directed to and restraining the defendant either by himself, the servants or agents from accessing the plaintiff home, children’s school or anywhere else except as shall be designated and supervised by this honourable court,” another request the CS made to the court read.

According to the court papers, the CS says she has been the sole breadwinner of their two biological children.

She claims to have been providing all of their basic needs including school fees, shelter and clothing.

Tuya further claims to have been faithfully paying 100 per cent of school fees, and school-related expenses towards the children at their previous and current schools as well as their full monthly maintenance and upkeep.

“Since our split in October 2020, he has refused to pay any share of school fees for the children despite being able to meet the same,” the court documents read.

The father of their biological children she says has also physically and emotionally neglected the care and protection of the minors.

“In December last year, he insulted me in a text message denying paternity of the two minors, demanding for a DNA test to ascertain his biological connection to the children,” she claims.

In the court papers, she explains how her estranged husband constantly and frequently displays a violent and uncaring attitude towards her since 2014.

“He committed untold physical, emotional and psychological harm on the children and me. He severely intimidated my domestic staff even sexually and physically threatening them on several occasions,” the court papers read.

She says he has throughout the subsistence of their cohabitation manifested total inability and reluctance to communicate.
