Reprieve for litigants seeking justice concerning water resources or water services as water disputes will now be solved within 180 days of filling.
The move comes after Cabinet Secretary for Water, Sanitation, and Irrigation Alice Wahome handed over the Water Appeal Board to the judiciary today.
During the handover ceremony at Chief Justice Martha Koome’s office in Nairobi, Wahome stated that the ministry now has over 100 pending cases that have been unresolved for the last 8 years and will be resolved.
The tribunal is now mandated to hear and determine any dispute concerning water resources or water services where there is a business contract unless the parties have otherwise agreed to an alternative dispute resolution mechanism.
It shall exercise the powers and functions set out in Act 2016, including hearing and deciding appeals brought by any person or institution directly affected by a decision or order of the Cabinet Secretary, the Authority and Regulatory Board, or any person acting under the authority of the Cabinet Secretary, the Authority and Regulatory Board.
