D-day for Former PS jailed in Ksh.283 Million cemetery scam

Former PS Sammy Kirui and two others who were jailed over an Sh283 million cemetery scam will know their fate in two weeks. By Gerald Gekara

In the court ruling, Justice John Onyiego ordered detention against Mr Kirui, Mr Alexander Musee and Ms Mary Ngethe after, one of the accused, Mary, reported she had fallen sick.

The trio are out on a Sh5 million bond each, as they await their ruling on an appeal.

Mr Kirui, who is the former Permanent Secretary for Local government, was found guilty of abuse of office.

However, the court acquitted charges preferred to him, citing that the prosecution did not prove allegations of abuse of office beyond reasonable doubt.

The court however, upheld the conviction of co-accused Mary Ngethe (former legal director at now-defunct City Council) and Alexander Musee (former tender committee chair at City Council).

They will serve three years in prison.

However, John Gakuo who had also been found guilty of abuse of office died in prison, while waiting for the appeal to be heard.
