A minor stunned a Kibera court by refusing to testify against her father in a defilement case in which the father is accused of defiling her.
The minor in question told the court that she sprained her arm and asked her father to straighten it, but a neighbor mistook her pain moans for sexual activity.
“It was during the Corona period, and I had twisted my arm one day and asked my father to massage me because I was in pain. I was only saying ‘ouch,’ and our neighbor misinterpreted it as sex “She stated.
Her father is accused of defiling her at their Keroka home in Kangemi, Nairobi County, in June 2020.
The minor claimed her father was massaging her in front of her sister, but she was crying in such a way that neighbors assumed she was being defiled.
She claimed that one of their neighbors, who was listening in on what was going on in the house, later claimed that the act was defilement.
“My father has never defiled me. Our next-door neighbor inquired as to why I was making such a racket at night. She was so convinced that my father had not defiled me that she summoned other neighbors and took him to the police station.”
The child also told the court that after her father was arrested, she was summoned to the police station and forced to record a statement in which she claimed her father defiled her.
The prosecution considered her a hostile witness after her testimony, but she insisted she was telling the truth.
She claimed to be a devout Christian who follows the doctrines of the SDA church and that everything she told the court was true.
The minor, who appeared in court with an infant, told Senior Principal Charles Mwaniki that she became pregnant while staying at a children’s home, where neighbors took her after the defilement allegations.
