Defense Lawyers pokes holes in prosecution’s evidence of four people implicated in murder case

The defense Lawyers pokes holes in prosecution evidence in a case where four people are charged with the murder of a young man which occurred in Uthiru Centre in Dagoretti in Nairobi County.

This came after the alleged eyewitness in the murder told court that he witnessed the beating of the deceased which later led to his death in 2024 while according to the charge sheet, the deceased died in 2023.

Joshua Ng’ethe Chege who allegedly saw the suspects dragging the deceased, told court that he lied to police that he had gone to buy cigarettes when he witnessed the assault.

Joshua who confirmed to be an alcoholic said that he could not risk telling police that he had gone to buy alcohol for fear of the police officers.

In the case, Michael Mbugua Njau, Christopher Njau Mbugua, Charles Kinyanjui Mwangi and Robert Kimotho Gichuki were charged with the murder of George Njui Mwaura on December 23, 2023.

Joshua identified a pipe he alleged he saw one of the suspects carrying on the fateful day but later changed his testimony saying he only saw a similar pipe.

In asking the court to reconsider its stand for the release of the suspects on bond, the defence told court that to the best of their knowledge all the vulnerable witnesses had already testified and hence it would be prudent to review bond terms for the suspects.

The case will proceed on March 12, 2025, at Kibera High Court.
