DPP Drops Murder Charge Against Tob Cohen’s Wife

The Director of Public Prosecutors has withdrawn murder charges against Tob Cohen’s widow Sarah Wairimu and her co-accused

Prosecutor Wangui Gichuhi told the court that they have filed a Nole prosequi in court seeking not to proceed with the matter.

The DPP in exercise of its mandate and powers under the constitution filed a nole. The intention is to withdraw criminal charges of Murder against Sarah Wairimu Kamotho and Peter Karanja.

The DPP has now filed to have Tob Cohen’s murder case filed as an inquest at the Chief Magistrates Court at Milimani.

The reasons for the withdrawal are that the investigating officer in case filed two affidavits in which he made certain averments concerning the matter with specific to the evidence and investigation process. In regard to the application, the DPP confirmed that some crucial limps of investigation like cell phone data were not availed to the prosecution.

Further, DPP confirmed that statements of key witnesses were never finalized. DPP said that his office believes that it is necessary to have the matter withdrawn to enable the areas highlighted to be covered effectively through an inquest.

DPP said his office could not in good faith proceed with the matter as it would not benefit the victims nor the public intrest.
