DPP moves to court seeking cancellation of bond terms of a Somali businessman

The DPP through the public prosecutor at the Kahawa Law Courts in Kiambu, has formally moved the Court to cancel bond terms of a Somali based man who is accused of obtaining Kenyan registration by false pretences.

In an affidavit filed by the ODPP, the suspect Abdirizak Mohamed Hassan has allegedly been sending threats to the key witnesses in the case who include the complainant who he purported to be his mother in an attempt to dupe the civil registration offices that he was indeed born in Kenya.

The State prosecutor Kennedy Kamau urged the Kahawa law courts principal magistrate David Kiage to cancel the bond terms of Abdirizak Mohammed Hassan for threatening the main witness.

According to the prosecution, the acts of the suspect has gone against the rules which were given to him by the court,

“Your honor the actions of the accused tends to jeopardize the proceedings of this case by contacting and threatening to harm the complainant if she fails to recuse herself in the matter,” submitted the prosecutor.

Kamau submitted before the court that the complainant in the matter one Athara Abey Ali was called by the accused where he directed her to meet at Moonlight Hotel in Nairobi.

The accused threatened to face dire consequences if she don’t cease to testify against him before the court in the criminal proceeding against him.

Abdirizak who did not deny having used her identity card to secure the registration of the certificate of birth, told her to ask any amount of money and he would give but to withdraw as a witness in the matter.

The accused was charged with the offence of personation where he stole the identity card of Abbey and used it to secure the certificate of birth which indicated that he is her son a fact which was false.

He was charged with obtaining registration by false pretences where he registered an identity card using the details of an unsuspecting couple pretending to be their son.

Abdirizak is suspected to have used the purported mother’s lost identity card to fake birth and death certificates in order to apply for a Kenyan passport which is still under verification thus also submitting false documents during application.

The said offences were committed at Mandera North Sub-County.

The ruling on bond cancellation application will be on March 13, 2025.
