The Director of Public Prosecutions has moved to the High Court seeking to overturn Waititu’s acquittal in money laundering case.
The appeal by the DPP appears to be a cross-appeal in the corruption case involving former Kiambu Governor and several co-accused were acquitted in money laundering charges.
The DPP argue that the trial Magistrate erred in both law and fact by failing to convict the accused persons despite the evidence presented.
The prosecution contends that the trial court failed to properly evaluate the evidence, which they believe demonstrated the accused’s involvement in money laundering.
They now want the appellate court to review the matter and impose appropriate legal penalties if a conviction is entered.
