Driver in Court Over Fatal Thika Road Accident

A man has been charged at the Milimani Traffic Court with causing death by dangerous driving contrary to Section 46 of the Traffic Act, Cap 403 Laws of Kenya.

According to the charge sheet, Gregory Namusonge Simiyu, on the 15th day of June 2025 at about 2130 hours along Thika Road Superhighway within Nairobi County, being the driver of a Toyota 110 Saloon, drove the said motor vehicle in a manner dangerous to the public, failing to maintain proper lane, and hit a motorcycle, ridden by Bernard Mwaura, causing his death on the spot.

The prosecution told the court that both the motor vehicle and the motorcycle were headed towards Thika from Nairobi when, on reaching the accident scene near Zimmerman footbridge, the motor vehicle, driving on the second lane from the left, changed to the first lane and rammed the motorcycle from behind.

As a result, the rider lost control, hit the guard rails, and sustained fatal head injuries
which lead to his death.

Police officers visited the scene, moved the deceased body to Kenyatta University Mortuary, and took both the motor vehicle and motorcycle to Kasarani Police Station.

Investigations were conducted, and the driver was found liable for the accident. A post- mortem report from Kenyatta University Mortuary, a motor vehicle inspection report for the motorcycle (make Bajaj) and the motor vehicle (make Toyota Saloon), as well as a sketch plan of the accident scene, were presented before court as exhibits.

The accused admitted that the prosecution’s facts were correct, telling the court he had driven for 40 years without ever causing an accident, and described the incident as very unfortunate and unintentional.

The magistrate granted the accused a cash bail of Ksh 100,000 with one contact person.

Mention of the case is set for September.
