A court has convicted a businessman who killed three people in a grisly road accident along James Gichuru road on April 15, 2012.
Mr. David Gichuki was convicted of three charges of causing death by reckless driving following an 11-year trial at the Kibera law courts.
Mr. Gichuki, who was driving his Toyota Land Cruiser on the wrong side of the road at 1 a.m., killed activist Gladwell Otieno’s son, Silvano Mandla Otieno, and two others who were in a Volkswagen Golf.
Mr. Gichuki was charged with three counts of causing death by reckless driving in violation of Section 46 of the Traffic Act and was found guilty on all charges.
He was also charged with careless driving, which is a violation of Penal Code Section 47 (1).
Mr. Gichuki had also been accused with driving while intoxicated.
Senior Principal Magistrate Derrick Kutto stated that the prosecution established the three accusations against Mr. Gichuki, but that no proof was presented showing that the accused was under the influence of alcohol at the time.
Mr Gichuki will return to court on April 20 for mitigation after his lawyer Danstan Omari pleaded for more time to prepare.
Prosecution counsel Allan Mogere urged the court to order a pre-sentencing report, where the Probation department will interview the convict and families of the victims, including the only survivor, which will be considered during sentencing.
